NOTICE OF SALE UNDER POWER GEORGIA, WHITFIELD COUNTY THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Juan Manuel Holguin, a married person to Mortgage Electronic Registration Systems, Inc., as nominee for RBMG, Inc., dated 03/28/2001, recorded in Deed Book 3418, Page 230, Whitfield County, Georgia records, as last transferred to U.S. Bank National Association, as Trustee, successor-in-interest to Wachovia Bank National Association, as Trustee for GSMPS Mortgage Loan Trust 2004-4, Mortgage Pass-Through Certificates, Series 2004-4 by assignment recorded or to be recorded in the Whitfield County, Georgia records conveying the after-described property to secure a Note in the original principal amount of Eighty-Seven Thousand Three Hundred Ten and 00/100 DOLLARS ($87,310.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash at the usual place for conducting Sheriff's sales in Whitfield County, Georgia, within the legal hours of sale on the first Tuesday in October 2016, the following described property: All that tract or parcel of land lying and being in Land Lot No. 177 in the 12th District and 3rd Section of Whitfield County, Georgia, and being part of Lots Nos. 37 and 38, in Block 2, Section 1, of Heritage Estates, as shown by plat of record in Plat Book 7, page 48 (Plat Cabinet A, Slide 233), in the Office of the Clerk of the Superior Court of Whitfield County, Georgia, and described as follows: BEGINNING at a point on the northerly side of Jamestown Court 275 feet westwardly along the northerly side of Jamestown Court from the northwesterly corner of the intersection of Jamestown Court and Underwood Street; thence south 82 degrees 39 minutes west along the northerly side of Jamestown Court 33 feet; thence continuing along the northerly side of Jamestown Court, north 49 degrees 34 minutes west 40 feet; thence north 26 degrees 23 minutes east 150.3 feet; thence south 77 degrees 31 minutes east 70 feet; thence south 25 degrees 36 minutes west 166.30 feet to the point of beginning. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Ocwen Loan Servicing, LLC, 1661 Worthington Road, Suite 100, West Palm Beach, FL 33409, 561-682-8000. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument. To the best knowledge and belief of the undersigned, the parties in possession of the property are Juan Holguin,Enriquez Maria or a tenant or tenants.
