NOTICE TO THE PUBLIC YOU ARE HEREBY NOTIFIED that on the 31st day of October, 2016, at 10:00 A.M., at the Whitfield County Courthouse in Dalton, Georgia, the presiding Judge of the Superior Court of Whitfield County will hear the case of STATE OF GEORGIA v. DEVELOPMENT AUTHORITY OF THE CITY OF DALTON and HAMILTON AMBULATORY SURGERY CENTER, INC., Civil Action File No. 16CI1349 - B, in the Superior Court of Whitfield County, the same being a proceeding to confirm and validate the Development Authority of the City of Dalton Participating Refunding Revenue Certificates (Hamilton Ambulatory Surgery Center, Inc. Project), Series 2016 (the "Series 2016 Certificates") and the security therefor. The Series 2016 Certificates are being issued by the Development Authority of the City of Dalton (the "Authority") for the purpose of refinancing $1,155,000 in aggregate principal amount of the outstanding Development Authority of the City of Dalton Revenue Certificates (Hamilton Health Care System), Series 1996 (the "Refunded Certificates"). The Refunded Certificates were issued to finance, in part, the cost of the acquisition, construction and equipping of a free-standing ambulatory surgical center (the "Project"), which is located at the same campus as the Hamilton Medical Center, and which is leased and operated by Hamilton Ambulatory Surgery Center, Inc. ("HASC"). In said proceeding, the Court will also pass upon the validity of a Trust Indenture, a Loan Agreement, a Promissory Note and a Note assignment to be executed and delivered in connection with the issuance of the Series 2016 Certificates. The Series 2016 Certificates will not constitute an indebtedness or obligation of the State of Georgia or any political subdivision or municipality thereof, including Whitfield County, Georgia and the City of Dalton, Georgia, and no taxes or property of the State of Georgia or any political subdivision or municipality thereof, including Whitfield County, Georgia and the City of Dalton, Georgia, shall be pledged to pay the Series 2016 Certificates. The Series 2016 Certificates will be limited obligations of the Authority payable solely from the moneys received by the Authority from HASC under a Loan Agreement between the Authority and HASC. Any citizen of the State of Georgia residing in Whitfield County, or any other person wherever residing, who has a right to object, may intervene and become a party to this proceeding.
