NOTICE OF SALE UNDER POWER GEORGIA, WHITFIELD COUNTY THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Amy R. Steinbeck to World Savings Bank FSB, dated October 9, 2007, recorded in Deed Book 5099, Page 23, Whitfield County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of SEVENTY THOUSAND FOUR HUNDRED AND 0/100 DOLLARS ($70,400.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash in the ground floor atrium area within the courthouse of Whitfield County, Georgia within the legal hours of sale on the first Tuesday in December, 2016, the following described property: SEE EXHIBIT “A” ATTACHED HERETO AND MADE A PART HEREOF The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Evans, Georgia Registered Land Surveyor No. 2168, dated January 30, 1990, as follows: Beginning at an iron pin place on the north right-of-way of Felker Circle (40 feet right-of-way) a distance of 340 feet east of the intersection of the center line of Highway 71 (Dalton-Cleveland Highway) with the north right-of-way of Felker Circle as measured along said Felker Circle (said beginning point being 5 feet north of an axle found at the original southwest corner of said Lot 73 in said subdivision); thence north 170 feet to an iron pin placed; thence east 75 feet to an iron pin found; thence south 170 feet to an iron pin placed on the north right-of-way of Felker Circle (said iron pin being 5 feet north of an axle found at the original southeast corner of Lot 75 in said subdivision); thence west along the north right-of-way of Felker Circle (40 feet right-of-way) 75 feet to an iron pin and the point of beginning. The above described property being all of Lots 48 through 50 and a portion of Lots 73 through 75 of Felker Subdivision; the portion of Lots 73 though 75 excepted in the above description being the south 5 feet of said Lots, which was conveyed as a part of the right-of-way for Felker Circle (40 feet right-of-way) as shown by deed to Whitfield County, Georgia, of record in Deed Book 263, page 145, dated October 15, 1970, Whitfield County Clerk§s Records.
