This is an attempt to collect a debt and any information obtained will be used for that purpose. NOTICE OF SALE UNDER POWER GEORGIA, WHITFIELD COUNTY Under and by virtue of Power of Sale contained in the Security Deed from Timothy D. McCoy and Kathy Jo McCoy (Grantor) to Popular Financial Services, LLC (“Lender”), in that certain SECURITY DEED dated April 18, 2006, recorded in Deed Book 4746, Page 50, in the deed records of WHITFIELD County, Georgia (the “Security Deed”), re-recorded in Deed Book 4797, Page 58 in the deed records of WHITFIELD County, Georgia and later assigned to Vanderbilt Mortgage and Finance, Inc. by that certain assignment dated April 14, 2011 and recorded in Deed Book 5594, Page 90. Said Security Deed being given to secure the obligations of Grantor to Lender as set forth in a Promissory Note of even date in the original principal amount of EIGHTY THOUSAND AND 00/100 ($80,000.00) as amended, modified, or revised from time to time (the “Note”), with interest at the rate specified therein, there will be sold, by the undersigned at public outcry to the highest bidder for cash, before the Courthouse Door at WHITFIELD COUNTY, Georgia, within the legal hours of sale on the first Tuesday in March, 2017, the following described property: A tract or parcel of land lying and being in Land Lot 240, 11th District, 3rd Section, Whitfield County, Georgia, and more particularly described as: Beginning at the southeast corner of Lot No. 5 of Wood Haven Place as shown on plat recorded in Plat Book 5, page 188, Deed Records of Whitfield County, Georgia. Thence running a distance northward of 225 feet to a point; thence running west a distance of 100 feet to a point; thence running south a distance of 225 feet to the southwest corner of Lot No, 5 of said subdivision; thence east along Patricia Drive a distance of 100 feet to the point of beginning, Permanently attached to this property is a manufactured (mobile) home described as follow: One 2004 Palm Harbor Mobile Home, Manufacturer's ID No.PH235454AB. This mobile home has been modified to become a permanent structure attached to the real estate and to be considered a part of the real estate. Commonly known as: 307 Patricia Lane, Dalton, GA 30721. Parcel # 11-240-01-013 The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including, but not limited to, the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys’ fees and other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by inspection of the property; any outstanding taxes, including but not limited to, ad valorem taxes, which constitute liens upon said property; special assessments; and all outstanding bills for public utilities which constitute liens upon said property; To the best of the knowledge and belief of the undersigned, the party in possession of the property is Timothy D.
