NOTICE OF PROPOSED SPECIAL USE PERMIT REVIEW Notice is hereby given that the Dalton-Varnell-Whitfield County Planning Commission and the Whitfield County Board of Commissioners will conduct a joint public hearing to hear the request of Alpesh Patel for a special use permit. The request is to consider a proposed Athletic Field on 21.8 acres located in the Low Density Single Family Residential (R-2) zone district. The subject tract being tax parcel 11-244-05-000 located at 1140 Tunnel hill-Varnell Road and is more specifically described as follows: All that tract or parcel of land lying and being in Land Lot 244 of the 11th District and 3rd Section of Whitfield County, Georgia, containing 21.8 acres, more or less, and being more particularly described as follows: COMMENCING at a point on the west side of Georgia Highway 201, said point being the southeast corner of the property now or formerly owned by the Alexander Estate heirs, and said point also being 1168 feet east of the northeast corner of said Land Lot 244; thence south 7 degrees 00 minutes west 770 feet along the west side of Georgia Highway 201 to the property nor or formerly owned by Holloway, thence north 89 degrees 24 minutes west 866 feet to a point; thence south 480 feet to the property now or formerly owned by Meadow Park Corporation; thence west 209 feet along the now or formerly Meadow Park Corporation property to other property now belonging to Meadow Park Corporation and the west land lot line of said Land Lot 244; thence north along the west line of said Land Lot 244, 1228 feet to the northwest corner of said Land Lot 244; thence east along the north land lot line of said Land Lot 244, 1168 feet to the point beginning. Being that identical property located in Land Lot 244 of the 11th District and 3rd Section of Whitfield County, Georgia, conveyed to Carl M. King by T.E. Walker and others by deed of record in Deed Book 65, page 446, Whitfield County, Georgia, Clerk's Records, as the description of said property located in Land Lot 244 of the 11th District and 3rd Section of Whitfield County, Georgia, was modified and more particularly described in Judgment of Court in the Superior Court of Whitfield County, Georgia, resulting from a Quiet Title Action, said judgment being recorded in Minute Book 40, Page 252, in the Office of the Clerk of the Superior Court of Whitfield County, Georgia, said judgment being dated January 2, 1967. LESS AND EXCEPT from the above described property that portion of same measuring 0.378 acres, more or less, conveyed as right of way at Deed Book 3138, Page 124, Whitfield County, Clerk's Records to Department of Transportation of Georgia and SUBJECT TO Access Rights conveyed therein. The request for a special use permit will be heard at a public hearing conducted by the Dalton-Whitfield County Planning Commission and the Whitfield County Board of Commissioners on Monday, June 26, 2017 at 6:00 p.m. in the Whitfield County Administrative Annex 2, 214 W. King Street, Commissioner's Chambers, Dalton, Georgia. The Planning Commission will thereafter provide a written recommendation for consideration by the Whitfield County Board of Commissioners.
