LEGAL NOTICE INVITATION FOR SALE BY SEALED BID Whitfield County Board of Commissioners will be accepting sealed bids until 2:00 pm, Thursday, July 6, 2017, at the Whitfield County Finance Department, 301 W. Crawford Street, Dalton, GA 30720 for ITB# FIN17-002, a portion of Map Parcel 12-183-03-000, consisting of approximately 1.463 acres, more or less, and the former Health Center building of approximately 16,000 SF, located at the intersection of Ross Drive, Applewood Drive and Memorial Drive, Dalton, GA. The property is described as: A tract or parcel of land located in Land Lot No. 183, of the 12th District and 3rd Section of Whitfield County, Georgia, and being a portion of Block “A” of the R. R. Burleyson Subdivision, as recorded in Plat Book 1, Page 220, Office of the Clerk of the Superior Court of Whitfield County, Georgia, being 1.463 acres, more or less, being more particularly described as follows: BEGINNING at a point which is the northeast corner of Tract 12 of Block “A” in the R. R. Burleyson Subdivision, recorded in Plat Book 1, Page 220, Office of the Clerk of the Superior Court of Whitfield County, Georgia; thence running west 177 feet; thence running north 178 feet to the south side of Ross Drive; thence running east 359 feet along the south side of Ross Drive to the west side of Applewood Drive, formerly known as Burleyson Street; thence running south 178 feet along the west side of said drive; thence running west 182 feet to the point of beginning. Said property is a portion of that 1.99 acre tract shown as the property of Whitfield County Health Center by plat recorded in Plat Book 4, Page 74, Whitfield County, Clerk’s Records. Being that identical property conveyed to Whitfield County, a political subdivision of the State of Georgia by Warranty Deed of record in Deed Book 106, Page 577, Whitfield County, Georgia, Clerk’s Records, LESS AND EXCEPT THE WEST 130 FEET THEREOF. Terms and Conditions Applicable to Sale are: (a) The property is being offered and will be sold “as is”, “where is” and “with all faults” and will be conveyed by quit claim deed only. Successful bidder shall indemnify and hold harmless Whitfield County, Georgia from any loss or liability resulting from the presence or release on the property at any time of any hazardous substances including asbestos, lead paint or any other pollutants; (b) At the time of submission of the offer, the Bidder must submit earnest money in certified funds made payable to Whitfield County Board of Commissioners in the amount of 10% of the bid amount. The earnest money of all unsuccessful bidders shall be immediately returned upon completion of the bid evaluation and acceptance by the Board of Commissioners; (c) At the time of submission of the offer, the Bidder must provide evidence of availability of funds from a banking intuition (Proof of Funds). A mortgage or loan commitment does not constitute Proof of Funds for purposes of this transaction; (d) Any and all due diligence and property inspections must be completed before the date of the bid opening; (e) Funds shall be collected from the Successful Bidder at the closing In the form of a cashier’s check, wire transfer or bank issued check; (f) All closing costs, including the County’s closing attorney’s fees, shall be borne by the Successful Bidder and shall be paid at closing; and (g) The County shall have the right to establish a RESERVE below which amount no offer shall be acceptable.
