STATE OF GEORGIA, COUNTY OF WHITFIELD NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by KEVIN BROOME to HAZEL CAMPBELL f/k/a HAZEL S. WILLIAMS, dated June 14, 2016 and recorded in Deed Book 6349, pages 8-11, Whitfield County Records, securing a note in the original principal amount of $225,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday of the month, August 1, 2017, during the legal hours of sale on the ground floor of the Atrium Area inside the Courthouse in the County of Whitfield, State of Georgia (the usual place for conducting public sales in said County) sell at public outcry to the highest bidder for cash, the property described in said Deed, to wit: Ten (10), more or less, of land being part of Land Lot No. 116 in the 12th District and 3rd Section of Whitfield County, Georgia, described as follows: COMMENCING at the northwest corner of said Lot No. 116; thence running east 460 feet on original line; thence south to the intersection of U.S. Highway 41 right-of-way and the southwest corner of Lot No. 1 of the Blue Mountain Estates, as shown by plat of record in Plat Book 7, page 96, in the Office of the Clerk of the Superior Court of Whitfield County, Georgia; thence west along said right of way of U.S. Highway No. 41 to the original west line of said Lot No. 116; thence north with said original west line of said Lot NO. 116; thence north with said west line to starting point. LESS AND EXCEPT that portion of the above described property conveyed to Department of Transportation in Right of Way Deed of record in Deed Book 923, page 153, Whitfield County, Clerks Records as additional right of way for State Route 3/U.S. Highway 41; and any portion of the above-described property which may have been conveyed as additional right of way to Department of Transportation for the same project by Right of Way Deed at Deed Book 912, Page 257, Whitfield County, Clerk's Records. SUBJECT TO Rights of Access conveyed to Department of Transportation by those right of way deeds of record in Deed Book 923, page 153 and Deed Book 912, page 257, Whitfield County, Clerk's Records. Said property is known as Hwy 41 N., Dalton, GA, 30720, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
