NOTICE TO THE PUBLIC YOU ARE HEREBY NOTIFIED that on the 12th day of January, 2018, at 2:00 P .M., at the Whitfield County Courthouse in Whitfield County, Georgia, Judge William T. Boyett of the Superior Court of Whitfield County will hear the case of the STATE OF GEORGIA v. CITY OF DAL TON BUILDING AUTHORITY and WHITFIELD COUNTY, GEORGIA, Civil Action File No. 17CI1664-B, in the Superior Court of Whitfield County, the same being a proceeding to confirm and validate an issue of the City of Dalton Building Authority Revenue Bond (Whitfield County Fire Station Project), Series 2018, (the "Series 2018 Bond"), in the principal amount not to exceed $4,000,000 to be issued by the City of Dalton Building Authority (the "Authority") to provide funds to (i) pay the costs of acquiring, constructing, and installing a new fire station and related equipment to be leased to Whitfield County, Georgia (the "County"), and (ii) pay expenses necessary to accomplish the foregoing. In said proceeding, the Court will also pass upon the validity of an Intergovernmental Lease Agreement, dated the date of its execution and delivery, between the Authority and the County, relating, among other things, to the obligation thereunder by the County to pay to the Authority amounts sufficient to pay the debt service on the Series 2018 Bond and to levy ad valorem property tax (if necessary), unlimited as to rate or amount, on the assessed value of all property in the County subject to such tax, in order to pay debt service on the Series 2018 Bond, and the validity of the Bond Resolution of the Authority in connection with the issuance of the Series 2018 Bond. THE AUTHORITY WILL NOT CONDUCT ANY PERFORMANCE AUDIT OR PERFORMANCE REVIEW WITH RESPECT TO THE SERIES 2018 BOND AS SUCH TERMS ARE DESCRIBED IN SECTION 36-82-100, OFFICIAL CODE OF GEORGIA ANNOTATED. Any citizen of the State of Georgia residing in the Whitfield County, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding.
