NOTICE TO THE PUBLIC YOU ARE HEREBY NOTIFIED that on the 12th day of January, 2018, at 2:00 P.M., at the Whitfield County Courthouse in the City of Dalton, Georgia, Judge William T. Boyett of the Superior Court of Whitfield County will hear the case of the STATE OF GEORGIA, Plaintiff, v. THE CITY OF DALTON BUILDING AUTHORITY and CITY OF DALTON, GEORGIA, Defendants, Civil Action File No. 17CI1665-B in the Superior Court of Whitfield County, the same being a proceeding to confirm and validate The City of Dalton Building Authority Revenue Bonds (Dalton Public School System Project), Series 2018 (the "Series 2018 Bonds"), in the aggregate principal amount of not to exceed $14,300,000. The Series 2018 Bonds are to be issued by The City of Dalton Building Authority (the "Authority") for the purpose of (i) providing funds to finance certain capital outlay projects for the Dalton School System consisting of (a) adding to, renovating, repairing, improving, equipping and furnishing existing school buildings or other buildings or facilities useful or desirable in connection therewith, including, but not limited to, Brookwood School, City Park School, Roan School and Dalton High School; (b) acquiring land; (c) acquiring new technology, safety and security equipment and other school equipment; (d) acquiring, constructing and equipping new school buildings and facilities, including, but not limited to, educational/athletic facilities; and (e) acquiring any property necessary or desirable therefor, both real and person (collectively, the "Projects") and (ii) paying the costs of issuing the Series 2018 Bonds. In said proceeding, the Court will also pass upon the validity of (i) an Intergovernmental Contract (the "Contract"), between the City of Dalton, Georgia (the "City") and the Authority, pursuant to which the City will agree to make certain payments to the Authority in an amount sufficient to pay principal and interest on the Series 2018 Bonds, such payments to be made from the proceeds of an annual tax levied on all taxable property located within the boundaries of the City, at such rate or rates, up to fourteen mills, as may be required to make such payments, and (ii) a Bond Resolution of the Authority which, together with the Contract, constitutes the security for the Series 2018 Bonds. Any citizen of the State of Georgia residing in Whitfield County, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding. The Authority will not conduct any performance audit or performance review with respect to the Series 2018 Bonds as such terms are described in Section 36-82-100, Official Code of Georgia Annotated.
