NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF WHITFIELD By virtue of the power of sale contained in a Security Deed dated September 27, 2010 filed for record March 14, 2011, and recorded in Deed Book 05581 page 067, Whitfield County, Georgia Records, given by Floyd Hiebert to Innovative Development Corp., there will be sold at public outcry for cash to the highest bidder before the Courthouse door of Whitfield County, Georgia, between the legal hours of sale on the first Tuesday in February, 2018 by Innovative Development Corp. the following described property, to wit: All that tract or parcel of land lying in Land Lots 107, 10th District, 3rd Section, Whitfield County, Georgia and designated as Lot(s) 41, Prospect Crossing Subdivision, Phase II, as shown on a plat prepared by Marcus Eugene Cook, RLS# 1935, dated July, 1996 and recorded in Plat Book Cabinet C. Page/Slide 1391 – 1392 Whitfield County Records to which reference is made for a complete and accurate legal description. Property is commonly known as 1220 Derby Drive, Cohutta, GA 30710. Said Security Deed was given to secure payment of a note being in the original principal amount of Eleven Thousand Five Hundred and 00/00 dollars. ($11,500), until reaching maturity on the unpaid balance as specified therein. The unpaid principal balance has been and is hereby declared due because of default under the terms of said Note and the Deed to Secure Debt. The debt remaining in default, said sale will be made for the purpose of applying the proceeds thereof toward the expenses of sale, including attorney’s fees, the payment of the debt and the interest thereon; and the balance, if any, shall be applied as provided by law. Said property will be sold subject and subordinate to the following items which may affect the title to said property; all zoning ordinances; matters which would disclosed by accurate survey or by inspection of the property; any outstanding taxes, including, but not limited to, ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easments, right of way and any other matters or record superior to said Security Deed. To the best knowledge and belief of the undersigned, Floyd Hiebert are parties in possession of the property. Notice has been given pursuant to and in compliance with O.C.G.A. 44-14-162, et. seq. The above-described property will be sold by the undersigned as attorney in fact for Floyd Hiebert subject to any unpaid taxes and assessments, and matters of record.
